What Happens When A Cyclist Is At Fault For A Car Collision?

It is not unusual to see a collision between a vehicle and a bicyclist, often resulting in serious injuries. While it is often the fault of the driver of the vehicle, the bicyclist can be at fault too. In many cases, it is crystal clear when the biker is at fault, so much so that you as the cyclist knows it. If you are certain you are at fault for an accident, there are several things you need to do:

Photograph the Scene

As long as you are not significantly injured, you need to photograph the scene of the accident. Take pictures of the vehicle, your bike, the roadway, and anything else that would help you in your case.

Remain Calm with the Other People in the Accident

No matter what, you need to remain calm and cooperate with the driver that was involved in the accident. Try to keep your emotions in check. The last thing you want to do is end up in the back of a patrol car because you caused a scene at the accident. That will not help you in your case at all.

Report the Accident to Your Insurance

If you are an avid cyclist, you need to have bicycle insurance. The policies are inexpensive but they cover your injuries and the damage to your bike. If you caused the accident, the driver's insurance is not going to pay for your damages, so having the extra insurance can be very beneficial.

Do Not Admit Fault

Although you may know for a fact that you caused the accident, you need to be very careful when you are speaking to the responding officer or other people involved in the accident. Even if you are the primary cause of the collision, there are many other variables that also contributed that you cannot be held completely responsible for. If you begin profusely apologizing and admitting fault at the scene, that can be used against you if a lawsuit comes to fruition. You will be able to fully explain how the accident unfolded when you are giving your statement to the police. They and the insurer will then determine who is at fault for the accident and the case will move forward.

Getting into an accident on your bike can be very scary. If you caused the accident, it can be even more concerning. Be sure to work with your attorney to ensure that you only take responsibility for your portion of fault.
